forced vaginal, anal or oral penetration, forced sexual intercourse, inappropriate touching, forced kissing, exhibitionism, voyeurism, obscene phone calls which torture a victim in a sexual manner.
Sexual assault occurs when an actor inflicts sexual intrusion or sexual penetration and the victim:
- is incapable of appraising the nature of the abuser’s conduct;
- submits erroneously, believing the actor to be the victim’s spouse;
- is less than 15 years of age and the actor is at least 4 years older than the victim;
- is physically helpless;
- has lost the power to self-appraise or self-control through employment of any drug or intoxicant by the abuser;
- is forced into submission by:
- actual application of physical force or physical violence;

- threat of imminent death, serious bodily injury, extreme pain;
- threat to retaliate in the future against the victim, or any other person;
- use of the position of supervisory or disciplinary authority (while the victim is in custody of law or detained in a hospital) unless the act is incident to a lawful search.
